Peak kW is an independent compressed air consultancy. These terms govern your use of this website and your engagement of our services. By working with us or using this site, you agree to them.

Our services

We provide professional engineering consulting: metered energy assessments, ultrasonic leak detection, continuous monitoring, and utility incentive support. Our reports and recommendations are advisory and specific to the facility and conditions assessed — they are not a substitute for licensed design, construction, or regulatory review by others, and are not intended for use at a different site or under different operating conditions without our review.

PeakOS software

PeakOS, our client-facing monitoring and reporting platform, is provided as part of an active engagement, on an as-is basis for that engagement's duration. We work to keep it available and accurate but do not guarantee uninterrupted access.

Your data

Facility and account data you share with us is handled as described in our Privacy Policy. We treat client facility data as confidential and do not sell or share it with third parties for their own marketing.

Intellectual property

Reports and deliverables we prepare for you are yours to use for your facility. Our underlying methodology, tools, and analysis techniques remain Peak kW's property, and are not transferred with a deliverable.

No guaranteed savings or incentive outcomes

Savings, payback, and utility incentive figures we provide are estimates based on the data available at the time — they are illustrative, not guarantees. Actual results depend on facility operation, utility rates, equipment condition, and third-party program approval, all of which are outside our control.

Limitation of liability

To the extent permitted by law, our liability arising from an engagement is limited to the fees you paid us for that engagement. We are not liable for indirect, incidental, or consequential damages.

Termination

Either party may end an engagement in accordance with the terms of the applicable proposal or contract. Sections concerning confidentiality, intellectual property, and limitation of liability survive termination.

Governing law

These terms are governed by the laws of the State of Utah, where our operations are based (Salt Lake City), without regard to conflict-of-law principles.
